    • 1. GENERAL PROVISIONS

    1. These Terms and Conditions (hereinafter referred to as the "Terms") define the rules for booking and short-term rental of apartments (hereinafter referred to as "Tyzenhauz apartments"), as well as the cancellation or modification of these bookings, the provision of additional services, and the provision of services by electronic means.
    2. The Terms and Conditions are an integral part of the agreement for the provision of temporary use of Apartments offered by the Service Provider, which is:

    3. These Terms and Conditions are the regulations referred to in Art. 8 Sec. 1 Point 1) of the Act of July 18, 2002 on the provision of services by electronic means.
    4. These Terms and Conditions are made available free of charge at: https://tyzenhauz.com/regulamin
    5. Integral parts of the Terms and Conditions are:
    6. Contact to the Service Provider for all matters related to the Terms and Conditions and service provision: phone: +48 570 044 540, email: booking@tyzenhauz.com. By making a reservation at Tyzenhauz Apartments, the Client accepts the provisions contained in these Terms and Conditions.

    2. DEFINITIONS

    The following terms used in the Terms and Conditions shall have the meaning defined below:

    1. Service Provider – means the civil partnership
      TYZENHAUZ s.c. Karolina Pietruska, Andrzej Pietruski,
      ul. Św. Sebastiana 16 lok. LU3, 31-049 Kraków,
      NIP 6762624624, REGON 522820986;
    2. Client – means any natural person over 18 years old with full legal capacity, a legal person, or an organizational unit without legal personality, granted legal capacity by law, who meets the requirements described in the Terms and Conditions and uses the services provided by the Service Provider, in particular makes bookings;
    3. Tyzenhauz Apartment – an apartment presented on the site and available for booking on the Service Provider's website or other platforms used for booking short-term accommodation (such as Booking, AirBnB);
    4. Agreement – means an agreement concluded electronically via the website https://tyzenhauz.com and its booking system ("System"), or other booking platforms;
    5. Service – means the short-term rental service of Tyzenhauz apartments;
    6. Short-term rental – making a residential unit available to Clients for a predetermined period, not exceeding 30 days, not intended to satisfy permanent housing needs; the provisions of the Act on the Protection of Tenants' Rights do not apply to short-term rental;
    7. Additional services – services other than short-term rental presented on the site, including packages;
    8. Service provided by electronic means – a service enabling reservation, payment, modification, or cancellation of bookings, as well as presentation of product offers;
    9. Website – the website https://tyzenhauz.com;
    10. System – the Tyzenhauz booking system available on the website;
    11. Apartment Terms and Conditions – regulations specifying the rules of stay in the Tyzenhauz Apartments constituting a separate document;
    12. Products – products presented on the Service Provider's website, offered for sale at the office or on the Allegro portal.

    3. SERVICES PROVIDED BY ELECTRONIC MEANS

    1. Services provided by electronic means consist of:
      • a) enabling the booking of Tyzenhauz Apartments or additional services,
      • b) enabling payment for services,
      • c) providing a newsletter service,
      • d) creating and maintaining an account on the website (if the option is available),
      • e) enabling contact via contact form,
      • f) presentation of the Service Provider's Products.
    2. The provision of services related to booking requires reading and accepting the Terms and Conditions, declaration of truthfulness of data, acceptance of the Privacy Policy, and selection of payment method.
    3. Requirements for using the services include: internet access, current operating system and web browser with cookies enabled, and an active e-mail address.
    4. Using electronic services is voluntary and free of charge. Rental agreements concluded via the System are subject to payment.
    5. It is forbidden to send content violating personal rights, offensive content, harmful software, or spam.

    4. BOOKINGS AND PAYMENT

    1. The subject of the service is the rental of the entire apartment. Reservations can be made via https://tyzenhauz.com or external portals.
    2. Online reservation requires specifying arrival/departure dates, number of persons, and choice of apartment.
    3. The Client provides personal data necessary for booking according to the Privacy Policy.
    4. Upon confirmation of the reservation and acceptance of the conditions, the rental agreement is considered concluded.
    5. Available payment methods: payment card, fast transfer (Przelewy24), BLIK, PayPal, Tpay.
    6. VAT invoices are issued upon request (NIP required at booking). From April 1, 2026, invoices for entrepreneurs are issued in the KSEF system.
    7. According to law, the Client has no right to withdraw from the accommodation agreement concluded at a distance if the agreement specifies a specific stay date.
    8. Change or cancellation of reservations is only possible for non-refundable offers, according to the conditions visible in the System.

    5. OTHER SERVICES PROVIDED BY ELECTRONIC MEANS

    1. Newsletter: subscription is voluntary, agreement concluded for an indefinite period. The Client may unsubscribe at any time.
    2. User account: may be deleted at the Client's request. Deletion of the account does not delete order history data.
    3. Products: online sales may be conducted via the Allegro portal under its regulations.

    6. LIABILITY

    1. The Client is responsible for selecting the reservation, providing correct data, and complying with the Terms and Conditions.
    2. The Service Provider is not responsible for incomplete bookings (e.g., abandoned shopping carts), the Client's lack of internet access, or payment operator errors.
    3. The Service Provider is not liable for non-performance of services resulting from force majeure (e.g., natural disasters, network failures, hacking attacks).
    4. The Service Provider reserves the right to temporary technical interruptions of the website, which will be announced in advance.

    7. OTHER MATTERS

    1. The Service Provider may terminate the electronic services agreement with 14 days' notice if the Client violates moral standards, sends spam, or provides false data.
    2. Complaints regarding electronic services should be submitted to booking@tyzenhauz.com. They will be considered within 14 days.

    8. COPYRIGHT

    1. All materials on the website (photos, texts, graphics) are protected by copyright and belong to the Service Provider or licensors.
    2. The Client may not use these materials commercially or reproduce them beyond the scope of permitted use.

    9. FINAL PROVISIONS

    1. Polish law applies to matters not regulated herein.
    2. The Service Provider may change the Terms and Conditions for important reasons, informing about it 14 days in advance on the website.
    3. Any disputes will be resolved by the court competent for the Service Provider's registered office, subject to consumers' rights to extrajudicial dispute resolution.
