I. GENERAL INFORMATION

  1. The Tyzenhauz Privacy Policy is addressed to Tyzenhauz Customers and specifies the type, scope, methods of use of data, rights and obligations of the Customer, as well as the protection of personal data. Non-acceptance of this Privacy Policy by the Customer is equivalent to the inability to use Tyzenhauz services, including those provided electronically.
  2. The Tyzenhauz Reservation Rules are available at the following address: https://www.tyzenhauz.com/regulamin. The Privacy Policy together with the Apartment Regulations/Stay Regulations constitute an integral part of the Reservation Rules, and the definitions contained therein apply accordingly to this Privacy Policy.
  3. The administrator of Customers' personal data is the Service Provider TYZENHAUZ s.c. Karolina Pietruska, Andrzej Pietruski, ul. Św. Sebastiana 16 lok. LU3, 31-049 Kraków NIP 6762624624, REGON 522820986, e-mail: booking@tyzenhauz.com.

II. DATA COLLECTION AND USE

  1. The Customer may browse the Website https://tyzenhauz.com, including viewing offers in the Reservation System, without the need to provide personal data or registration, subject to the provisions of the subsection below [automatically collected data].
  2. When the Customer uses the website, data concerning the Customer are automatically collected. These data include: IP address, domain name, browser type, operating system type. These data may be collected through cookies ("cookies"). Providing the Customer's personal data is only necessary at the stage of making a reservation in the system.
  3. According to the Rules, one of the conditions for making a reservation by the Customer is to provide the Customer's data. The Customer provides their data voluntarily; however, failure to provide certain data may make it impossible to make a reservation, as the Service Provider will not be able to accept or confirm the reservation and conclude the contract for the provision of services covered by the reservation, contact the Customer to determine details, or accept payment.
  4. The Service Provider collects the following Customer data: first and last names, tax identification number NIP (if invoicing is required), e-mail address, contact phone number, address, data required to make payments for apartment reservations or additional services, and if login is available, also nickname/login.
  5. The Service Provider collects Customer data based on and for the purposes of:
    • the execution of the contract for the provision of electronic services (Art. 6 para. 1 point b of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data "hereinafter GDPR"),
    • acceptance and handling of reservations and conclusion of the contract for the provision of Services and/or Additional Services (Art. 6 para. 1 point b GDPR),
    • proper performance of the above-mentioned contracts referred to in point b, including payment processes, handling complaints, objections, and Customer inquiries, and pursuing claims (Art. 6 para. 1 points b, d, f GDPR),
    • fulfilling legal obligations imposed on the Service Provider, including bookkeeping and accounting documentation, as well as the exercise of rights of data subjects (Art. 6 para. 1 point c GDPR),
    • marketing and promotion in terms of marketing and promotion of own services (Art. 6 para. 1 point f GDPR),
    • sending commercial information electronically only if the Customer has given consent, after obtaining consent for processing data for this purpose (Art. 6 para. 1 point a GDPR),
    • adjusting, measuring, and improving website services (Art. 6 para. 1 point f GDPR).
  6. If the Service Provider enables website functions involving account registration, Customer account registration requires the Customer to provide a username (login) and Password. The username and Password are confidential and should be guarded by the Customer against unauthorized use.
  7. Providing personal data is voluntary but necessary to conclude the contract and provide services.
  8. The Service Provider transfers Customer data to other entities providing services on behalf of the Customer or involved in the reservation process based on data processing agreements within the scope necessary to perform the indicated activities. This means personal data is entrusted to:
    • entities providing and supporting the website service system, reservation system, and e-mail,
    • payment operators, e.g., Przelewy24,
    • entities providing accounting services for the Service Provider, which involves access to some sales data (e.g., name and surname, data visible during bank transfer payment, etc.) and if necessary - entities providing legal services to the Service Provider,
    • if the Service Provider’s website has this functionality, providers of social plug-ins placed on the website enabling Customers to log into their Customer account using social media login data,
    • in case of Customers requesting a VAT invoice, the Customer's personal data and full transaction details will be included in the invoice sent to KSEF.
  9. If the Customer consents to the processing of their personal data for marketing purposes, Customer data may be collected and used by the Service Provider to present commercial offers, grant discounts, conduct contests, promotional campaigns, and other marketing activities of a similar nature.
  10. If the Customer consents to the processing of their personal data to receive commercial information in the form of newsletters under the Act of 18 July 2002 on electronic services (Journal of Laws 2002, No. 144, item 1204, as amended), Customer data may be collected and used by the Service Provider. Giving consent to process personal data for receiving commercial information also means consent for processing personal data for marketing purposes.
  11. It is possible to collect the IP addresses of Customers visiting the Website for diagnosing technical problems and creating statistical analyses. Furthermore, this data may be used for administration and improvement of the Website and reservation system.
  12. Personal data will be processed for the period necessary to perform the contract for the provision of services and/or additional services and electronic service provision, and afterward for the purposes and duration required by law, as well as until revocation of given consents.

III. PERSONAL DATA PROTECTION

  1. The Service Provider, as data controller, and third parties entrusted with data processing under separate agreements, apply technical and organizational measures necessary to protect the data required by applicable law, in particular to secure Customers' personal data against unauthorized disclosure, loss, or damage.
  2. The Customer is obliged to immediately notify the Service Provider about unauthorized use of their Customer Account or any other identified breaches of security rules related to using the Website and the reservation system.
  3. The Customer's personal data will not be transferred to a third country.
  4. The Customer's personal data will not be the basis for automated decision-making or profiling.
  5. Every person, to the extent provided by law, has the right to access their data, correct it, delete it, restrict processing, object to processing, data portability, and withdraw consent at any time. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.
  6. The Customer also has the right to lodge a complaint with the supervisory authority, i.e., the President of the Personal Data Protection Office.

IV. COOKIES

  1. Cookies mentioned in section II, paragraph 2, are files sent to the Customer's computer or other device when browsing the Tyzenhauz website and reservation system. Cookies remember Customer preferences, enabling, among others: Cookies do not cause configuration changes in the device or software installed on the Customer's device.
    • improving the quality of service and services provided,
    • improving search results and relevancy of displayed results,
    • creating viewership statistics,
    • determining user preferences, including the Customer, and adapting offers to their needs.
  2. The Service Provider uses the following types of cookies:
    • Essential cookies: Cookies necessary for the operation of services available on the website, enabling browsing offers or making reservations, supporting security mechanisms such as user authentication and fraud detection. These files are required for the proper functioning of the website. They do not require your consent.
    • Analytical cookies: Cookies enabling the collection of information about how users use the website to optimize its function and tailor to user expectations. By consenting to these cookies, you agree to the processing of data about your activity on the site for analytical purposes.
    • Marketing cookies: Cookies enabling the display of marketing content tailored to user preferences and sending notifications about marketing offers matching their interests, including information about Customer activity, products, and services of the site administrator and third parties. Consent to these cookies means your data may be used for ad personalization and effectiveness analysis of our advertising campaigns. These cookies are tracking cookies.
  3. Social media

Links to profiles on Facebook, Instagram, and LinkedIn are also placed on the Tyzenhauz site, and buttons referring to these sites and using their functions (e.g., "pin", "like", "share" buttons) may be present. This content is embedded using code from Facebook, Instagram, and LinkedIn (sites located in the USA), places cookies, and may store and process certain information for personalized advertising purposes. To learn how Facebook, Instagram, and LinkedIn use the cookies they collect, you should read the privacy policies and cookie rules on those sites.

  1. Cookies placed on the Tyzenhauz site:
    • Essential cookies: Cookies necessary for the operation of services available on the website, enabling browsing offers or making reservations, supporting security mechanisms, including user authentication and fraud detection. These files are required for the proper functioning of the website. They do not require your consent.
    • Analytical cookies: Cookies enabling the collection of information about how users use the website to optimize its function and tailor to user expectations. By consenting to these cookies, you agree to the processing of data about your activity on the site for analytical purposes.
    • Marketing cookies: Cookies enabling the display of marketing content tailored to user preferences and sending notifications about marketing offers matching their interests, including information about Customer activity, products, and services of the site administrator and third parties. Consent to these cookies means your data may be used for ad personalization and effectiveness analysis of our advertising campaigns. These cookies are tracking cookies.
    • Third-party cookies: Our site uses external services such as Google Analytics and Meta Pixel (Facebook and Instagram). This means information collected by these cookies may be sent to partners for traffic analysis and ad personalization on external platforms (e.g., Google search or Facebook).
  2. Cookies settings: Upon first visiting the Tyzenhauz site, a message (pop-up) appears explaining cookies, allowing acceptance, rejection, or access to cookie settings. If the option "cookie settings" is chosen, the Customer can consent to the use by the Service Provider of cookie categories and plug-ins selected in the pop-up.
  3. The use of cookies can also be disabled via the browser, but the site may not function properly. The Customer can use the browser to automatically or manually delete cookies. They can also specify that some cookies should not be placed. Another option is to change browser settings to receive a notification each time a cookie is placed. For more information on these options, please consult the help section of your browser.
  4. The Tyzenhauz site may not function properly if all cookies are disabled. If cookies are deleted in the browser, they will be placed again upon re-visiting the Tyzenhauz site after consent is given.

V. FINAL PROVISIONS

  1. The Privacy Policy comes into effect on 01.05.2026.
  2. The principles specified in the Privacy Policy are subject to Polish law. The provisions of this Privacy Policy do not exclude or limit any rights of the Customer who is also a Consumer under mandatory applicable law. In case of conflict between the provisions of this Privacy Policy and such laws, those laws prevail.
  3. Amendments to the Privacy Policy may be made according to the terms specified in the Rules.
